When our representatives are making important
decisions that impact all of our lives I believe it is important to ask
one basic question before making
those decisions, Is this good for
the children? Just imagine what our world would be
like if that question was asked prior to making decisions about going to
war, the environment, education or healthcare.

Kerlow, Domestic

Court Reform

1. Commentary by Elaine B. Holtz:
October is Domestic Violence
Awareness Month.
I have a special guest joining
me in the studio. Sarah Kerlow
an advocate for Domestic
Violence Prevention who is also
a survivor of Domestic Violence.
We will be talking about
Domestic Violence and The Family
Court Awareness Month which will
be happening in November. I plan
to feature the co-founders of
the Family Court Awareness Month
on the show of November
7th to talk more about this topic.
Family Court Awareness Month was created in 2020 by Tina
Swithin, founder of
One Mom’s Battle. The goal of Family Court Awareness Month is to shine a spotlight on systemic issues that are placing children in harm’s way. In collaboration with Sandra Ross of
California Protective Parents Association, the inaugural year was memorialized with a cross-country tour that started in California and ended in North Carolina. Along the way, Swithin stopped in seven major cities to meet with media, domestic violence advocates, family court professionals, and with survivors of post separation abuse.
Click here for our history. We declared November as Family Court Awareness Month!
2. Our
Guest Sarah Kerlow
shares her personal experience
with the Family Court process,
which appears to operate on the
assumption that 50% child
custody for each parent must
occur, even if a spouse is
accused of domestic violence and
there is a history of
restraining orders. Piqui's Law,
Keeping Children Safe from
Family Violence, is named for a
5-year-old murdered by his
father. The boy’s mother, Ana
Estevez, fought in family court
to protect her son against her
ex-husband before Piqui’s death.
The bill was introduced by CA
State Senator Susan Rubio as
SB616, was passed by the CA
Assembly in August 2022, but
apparently needs work to pass as
a final bill. Listeners are
urged to contact their state
senator and assemblyperson to
urge them to pass Piqui's Law.
Sarah cites the Center for
Judicial Excellence, whose
"mission is to protect
vulnerable children in the
family court system and to
strengthen the integrity of all
courts by creating judicial
accountability," that women and
children are still viewed as
inferior to men. Sarah talks of
the high cost to the divorced
mother to protect her children
imposed by the Family Court
industry of consultants and
advisors. She believes there
should be a Children's Bill of
Rights to protect children from
the domestic violence of a
divorced spouse.
About our Guest:
Sarah Kerlow
describes herself as a single
mother-Domestic Violence
survivor-activist-scholar. She
holds a master’s degree in human
Rights Education and is
currently finishing a Doctorate
in Education at University of
San Francisco She has been, and
continues to be, inspired, and
humbled by those ordinarily
extraordinary women in her life;
namely survivor warrior mamas
who work tirelessly to protect,
honor, and nurture their
children. As a survivor herself
of domestic violence she is
still is subjected to her abuser
through the court ordered and
court sanctioned violence
against her children, as her
abuser still retains 50-50
custody. Her deep belief is that
to address the myriad human
rights violations taking place
against women and children in
the family court, we must
create, support, and embrace
survivor-led initiatives,
organizations, and legislation.
Her greatest joy and
accomplishment are mothering her
five incredible children.
